Commercial Litigation and Health Law
Practice Overview
Mr. Foster engages in a broad commercial litigation practice, representing individuals and a broad array of business interests, including business entities located in Tennessee, other parts of the United States, and abroad. Many of his cases involve complex litigation, and he handles matters in both state and federal courts at the pre-trial, trial and appeals stages. In addition to litigation, Mr. Foster has assisted clients in alternative dispute resolution processes, such as arbitration and mediation.
Mr. Foster also practices in the area of health care law, including advising health care providers regarding appropriate responses to subpoenas and requests for medical records protected by HIPAA and other laws relating to the privacy of medical records.
Practice Achievements
In 2006, Mr. Foster successfully argued a motion seeking Rule 11 sanctions against an opposing party for improper litigation tactics in a lender liability action. This motion resulted in a judgment of $700,000.00 for Mr. Foster’s client. See November 2, 2006 Order, Blount County Circuit Court, Equity Division, Case No. E-18053. The Knoxville News-Sentinel stated in a November 14, 2006 article that this sanctions judgment, together with a sanctions judgment granted to another defendant in the same case, was “believed to be the largest ever levied against a plaintiff by a Tennessee court.”
Pro bono work has also been a part of Mr. Foster’s practice, which he values as providing access to the justice system for those who could not otherwise afford legal representation. In 2005, Mr. Foster obtained innocent spouse relief through an Internal Revenue Service administrative appeal on behalf of a woman whose ex-husband was charged with abusing the couple’s children.
